FIFPro supports Adrian Mutu in CAS appeal case

Yesterday at a press conference which it convened in Constanza, Romania, FIFPro announced via its lawyer Wil van Megen that, from its point of view, it believes the sum of more than €17 million which FIFA’s Dispute Resolution Chamber has ordered the Romanian footballer Adrian Mutu to pay in compensation to Chelsea following his sacking from the English club to be disproportionate.

Wil van Megen sees a number of clear possibilities which, in his view, should lead to an extremely positive outcome for Mutu in the appeal which the Romanian has lodged with the CAS against the verdict of the DRC.

FIFPro’s arguments are as follows:

The sum of €17 million consists fully of the residual value of the transfer sum of €22.5 million which Chelsea paid to Mutu’s former club Parma in 2003. However, Mutu had no say whatsoever with regards to the amount of the transfer fee which was agreed between the clubs.

Chelsea did not take anywhere near enough action in order limit damages in this case.

According to the FIFA Regulations, the DRC is only authorised to give a verdict in cases with an international dimension. This means that if, instead of Mutu, it had been a player with a British passport, the DRC could have dismissed the case and therefore no compensation would have had to be paid. Consequently, Mutu can appeal to the fact that he is being discriminated against on the basis of his nationality.

The FIFA Regulations also stipulate that the new club (Livorno/Juventus) is responsible, together with the player, for paying compensation to the previous club. It is particularly noteworthy that this has not happened at all in this case.

FIFPro and Van Megen are therefore convinced that Adrian Mutu has every chance of success in his appeal at the CAS.
